TOURISM ADVISORS, S.L. (here-in after ENJOYBARCELONA) here by rents the Apartment detailed in the front page of this Rental Agreement to the Customer subject to the following Terms and Conditions.

  1. Nature of this agreement.
    The rights and obligations contained in this Rental Agreement govern the use by the Customer of the apartment. By signing this Rental Agreement the Customer and all guests and companions accept the terms of the Rental Agreement and confirm the strictly comply with them.
  2. Check in and check out.
    Check in shall be done after 4:00 P.M. Earlier arrivals shall be checked in subject to availability of the apartment at their arrival time. Check in after 21:00 h has extra charge of 20 Euros and after 23:00 h a extra charge of 35 Euros.
    The Customer must inform in advance for any delay. ENJOYBARCELONA will be waiting the Customer at the apartment to welcome, show the apartment and, give the Customer the keys and inform him/her personally about all the details of it.
    Check out shall be done between 11:00 AM and 12:00 PM. If the Customer is leaving before that time ENJOYBARCELONA must be informed in advance with enough time.
  3. Payment.
    Upon reservation, payment of 30% of the total invoice is required. This payment can be made by credit card or bank transfer. The reservation shall not be confirmed until ENJOYBARCELONA receives the amount specified. In the event the 30% payment is done by bank transfer, the Customer must send ENJOYBARCELONA a copy of the bank receipt to confirm the payment.
    The remaining 70% of the invoice shall be paid upon checking in cash or by credit card.
  4. Customers obligations.

4.1 The Customer undertakes to respect the rules that pertain to the apartment and the community it belongs to.

4.2 The Customer and guests must treat the property and furnishings of the apartment with total respect.

4.3 The Customer undertakes to turn off the air-conditioning or lights if he/she leaves the apartment.

4.4 The Customer undertakes to keep save the keys of the Apartment. In the event that the Customer looses the keys or leave them inside the apartment ENJOYBARCELONA shall, as soon as possible, facilitate him the access to the property against the payment of a penalty of 30 Euros in cash.

4.5 The Customer agrees to do the check out on the date specifically stated in the front page of this Agreement and at the time established in clause 2. In the event of infringement of the aforementioned obligation, ENJOYBARCELONA shall be entitled to claim the Customer an amount equivalent to the price of one-day stay plus in its case the damages and expenses incurred.

4.6 The Customer agrees to return the apartment in the same conditions as rented it, with the same parts and accessories and on the date and time designated in this Rental Agreement.

4.7 The Customer shall be liable for the correct and decent behaviour of all the persons accompanying him/her. Should the Costumer, or any of the persons accompanying him/her not behave in accordance with normal civic standards, ENJOYBARCELONA shall be entitled to request the Customer and the persons accompanying him/her to leave the apartment without the right for the latter to claim any compensation whatsoever.

  1. Numbers and identity of the guests.
    The Customer when check in shall provide ENJOYBARCELONA all his/her identity data (name, surname, ID or passport, telephone number, and e-mail address) as well as the number of persons who shall be occupying the apartment.
    The number of persons who shall be occupying the apartment may not exceed in any case the number of sleeping places indicated for each one of the apartments. Pet animals are not allowed.
    In the event of any infringement of the aforementioned obligations, ENJOYBARCELONA at its sole discretion shall be entitled to request the Customer to leave the apartment, and the Customer shall have no right to claim any compensation.
  2. Customers responsability.
    The Customer shall be liable to ENJOYBARCELONA for all reasonable losses and cost incurred by ENJOYBARCELONA in the event of loss or damage to the apartment, its parts or accessories while on rental. The Customer’s liability may include the costs of repairs, loss in value of the property loss of rental income, an administration charge, which recovers ENJOYBARCELONA costs for handling any claim arising from damage caused to the apartment unless responsibility for the damage lies with ENJOYBARCELONA or by a third party.
    Customer will not be liable to ENJOYBARCELONA for any charge or excess if the loss or damage is directly due to ENJOYBARCELONA negligence or breach of this Rental Agreement.
  3. Supplies.
    Water and electricity supplies are included in the apartment rental price. The apartment is provided with towels and sheets for all the guests.
  4. Cleaning.
    The apartment will be cleaned prior of the arrival of each Customer. When leaving the apartment, it must be in reasonable conditions of cleaning and order (clean kitchen, no rubbish, etc.). If the apartment is not left in the above conditions, ENJOYBARCELONA is entitled to ask for additional cleaning charges against the security deposit. ENJOYBARCELONA has an additional cleaning service (daily) available upon the request of the Customer. Those services must be requested in advance to ensure a proper organisation.
  5. Responsability for property.
    Neither ENJOYBARCELONA nor its agent(s) shall be held liable for any loss of or damage to property left in the apartment either during or after the period of rental unless the loss or damage results from ENJOYBARCELONA negligence or breach of this Rental Agreement. Such property is entirely at the Customer’s own risk.
    ENJOYBARCELONA shall not be liable to the Customer or any third party for any loss or damage arising from the rental other that as a result of ENJOYBARCELONA negligence or wilful misconduct or any other breach by ENJOYBARCELONA of this Rental Agreement. ENJOYBARCELONA shall not be liable for any indirect or unforeseeable loss or damage, including loss of profit or loss of opportunity.
  6. Security deposit.
    ENJOYBARCELONA has the right to demand the Customer upon booking, a security deposit to cover the costs of any damage or breakage caused in the property or any of its assets, either inside or outside the apartment, during the stay of the Customer and his/her guests, excluding normal wear and tear. The security deposit shall be reimbursed to the Customer when leaving the apartment if everything is in order. Refunds are at ENJOYBARCELONA’s discretion. In the event that damages caused in the property are superior to the amount of the security deposit the Customer shall be liable to pay for the additional costs and expenses.
    The security deposit must be taken in Cash or by Credit Card (VISA or MASTERCARD only).
    In the event that an amount has to be charged related to the general conditions of the Agreement (outstanding amounts due on the price, any damage suffered by the Apartment, or any other charge, penalty or sum due to negligence of the Customer), the Customer hereby authorises ENJOYBARCELONA to charge said sums, costs or expenses to the credit card provided, without any prior authorisation, subsequently sending the receipt to the Customer.
  7. Personal data enjoybarcelona.
    In compliance with Personal Data Protection Legislation in force, ENJOYBARCELONA will keep the Customer’s personal data in a file under the company’s responsibility, with the purpose of promoting and holding commercial relationships with the Customer.
    At anytime the Customer may exercise its rights of objection, access, rectification and cancellation addressing it’s notice to Customer Service Department of TOURISM ADVISORS, S.L, Plaza Real, 3, entresuelo, 08002 Barcelona.
  8. Applicable Law.
    This Agreement shall be governed by and construed in accordance with the substantive laws of Spain.
    Any dispute, controversy or claim arising out of or in connection with this Agreement, or the breach, termination or invalidity thereof, the parties renounce expressly to any other applicable jurisdiction, and submit to the Courts and Tribunals of Barcelona (Spain).
